Terms of Service

These terms are an agreement between you and BRAxIUM LLC (“BRAxIUM”, “we”) about BRAxIUM Labs at labs.getbraxium.com (“Labs”). By creating an account, buying a plan or using Labs, you agree to them and to our Privacy page. If you do not agree, please do not use Labs.

What Labs is

Labs is a practice tool for spoken communication. It plays the part of a listener, measures observable things about how you spoke, and suggests something to try next. It is for education and self-improvement. It is not therapy, medical, legal, financial or career advice, and it does not diagnose anything. Please do not use Labs, or its measurements, to make decisions about hiring, firing, grading or evaluating other people.

Labs gives no guarantee about results. Skills improve with practice, and how much is up to you.

Your account

• You must be at least 18 years old, or have the legal right to enter this agreement where you live.
• You sign in with a code sent to your email address. Keep your email account secure. You are responsible for activity on your account.
• Give accurate information and keep one personal account. Do not share your account or sell access to it.
• You can use Labs as a guest. Guest progress is stored only in your browser until you choose to save it to an account.

Plans, billing and cancellation

• Free gives the lessons, warmups and drills marked as free. It stays free.
• Paid plans (Voice Pro, Complete and the team plans) are subscriptions billed in US dollars, monthly or yearly as you choose. They renew automatically until you cancel.
• Payment is handled by Stripe. We do not see or store your card number. Prices are shown before you pay. Taxes are added where required.
• Cancel any time from your account (Manage billing). Your plan then stays active until the end of the period you paid for, and does not renew.
• Price changes apply to renewals after we tell you by email at least 30 days ahead. You can cancel before the change takes effect.
• Failed payments. If a payment fails, Stripe retries it. Your paid access continues until the end of the paid period and then returns to Free until the payment is fixed.
• Refunds are covered by our Refund policy.

The 30-day experience

New personal accounts can start one 30-day experience with the Complete features. It needs no card and never turns into a paid subscription by itself. When it ends, your account returns to Free and your progress stays. It is limited to one per person, and we may decline it if we see misuse.

Teams

A team workspace is created by the person who buys a team plan (the owner). The owner is responsible for the people they invite and for the team subscription. Each plan includes a number of active learner seats. Invited people join by signing in with the invited email address. Removing someone frees their seat.

Owners and managers can see each member’s email address, role, lessons completed, assignment progress and, on the Growth plan, recent practice counts. They cannot see recordings, practice text or private notes. If the team subscription ends, members lose team access and keep their own accounts and progress. If you join a team, you can leave it at any time by asking the owner or by contacting us.

Acceptable use

Do not misuse Labs. In particular, do not: break the law; try to access other people’s accounts or data; probe, overload or attack the service; scrape it or copy it in bulk; reverse engineer it except as the law allows; use it to harass or deceive anyone; or use it to record or analyze other people without their consent. We may suspend accounts that put others or the service at risk.

Your content and data

Recordings are analyzed in your browser and are never uploaded or stored by us. The measurements, lesson progress and plan you choose to save to an account belong to you. You give us permission to store and process them only to run Labs for you, as described in our Privacy page. You can download your data and delete your account from your account page.

Labs, its lessons, design and software belong to BRAxIUM and its licensors. Coaching ideas are credited to their sources on our Credits page, and credit does not mean those people endorse Labs. We give you a personal, non-exclusive, non-transferable right to use Labs while you comply with these terms.

Availability and changes

We work to keep Labs available, but it may be interrupted for maintenance, outages or reasons outside our control. We may add, change or remove features. If we remove a feature of a plan you paid for in a way that materially reduces it, we will tell you and you may ask for a prorated refund for the unused period.

Ending your use

You can stop at any time and delete your account from your account page. We may suspend or end access if you break these terms, if a payment is reversed or abused, or if we must by law. Sections that by their nature should continue, such as ownership, disclaimers and limits of liability, continue after your account ends.

Disclaimers and limits of liability

Labs is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, including that Labs will be uninterrupted, error free or suited to a particular purpose, and that its measurements are exact. Microphone and camera analysis can be wrong or affected by your device and surroundings.

To the fullest extent the law allows, BRAxIUM is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or opportunities. Our total liability for any claim relating to Labs is limited to the amount you paid us in the 12 months before the claim, or $50 if you paid nothing. Some places do not allow some of these limits, so they apply only as far as the law permits. Nothing here limits rights you have under law that cannot be waived.

Changes to these terms

We may update these terms. For material changes we will email account holders or show a notice in Labs before they apply. If you keep using Labs after the date shown, you accept the updated terms. If you do not, you can cancel and stop using Labs.

Disputes and contact

If something goes wrong, please email us first at hello@getbraxium.com and we will try to fix it. These terms are governed by the laws of the United States and of the state where BRAxIUM LLC is organized, and disputes will be brought in the courts there, except where the law gives you the right to bring a claim where you live.
